REGULAR MEETING

ROLL CALL - Councilor Jacobs, McNabb, Hunter – Present.  Councilor Dempsey and Mayor Carnicelli absent.  Councilor McNabb served as acting Mayor and explained that Mayor Carnicelli had a schedule conflict and was going to be late.  Councilor McNabb explained that several items on the agenda would require 4 yes votes and asked that the agenda be reorganized for those items to be up when the Mayor arrived. All agreed.

City Staff present:  City Manager John Salomone, Corporation Counsel Tom Leone, City Clerk Debra McCormick, Gary Giannotta Police Chief, Bea O Hora, Comptroller, Vijay Mital Director of Planning, William Lupien, Superintendent of Engineering Services.

City Manager’s Report -   
The City Manager reported the following:
·       The County will be using City Hall for a meeting once a month while the County Office Building is repaired.
·       In response to neighborhood concern regarding the 42 Lincoln St. residents the Auburn Police had increased patrol of the area most of the night and 2 arrests were made.  The Chief spoke and reported tenants were moving out.
·       Responding to last weeks topic brought to council regarding limiting the number of cats in an area, Mr. Salomone reported there is no limit in a residential home.  City staff is reviewing the feasibility of limiting the number and the enforcement issues that would arise.
·       In answer to a question last week, the city mows lawns of neglectful owners at our own peril as far as liability insurance goes.  Also planting trees on private property increases liability to city.
·       The city phone listings in the phone book will be reviewed in the spring in answer to Councilor Hunter’s suggestion that they are not clear.
·       A public hearing was held on July 16 by the National Park Service regarding the designation of the Harriet Tubman home as National Park.  Councilor Dempsey and Mayor Carnicelli and over 70 people attended.  This process will take about 2 years.
·       Next week council will discuss the new boundaries for city election districts.


Public to be Heard
Mike O’Neil, 26 ½ Hockeborne Ave. submitted a letter to each member of council and spoke on the topic of tipping fee rate reduction for new commercial construction.

Bill Dobson, Sheppard Rd. – spoke to tell council his tenant at 42 Lincoln St. is moving out.  He thanked the Auburn Police Department for their help, the neighbors, and council for hearing and responding to concerns.

Gary Baldwin, 40 Lincoln St. Thanked the Auburn Police, Council for their help with the situation on Lincoln St.  He thanked the Mayor for coming in person to his house on Saturday morning.  

Amy Dobson – Carver, Sheppard Rd. – Thanked Council and the Auburn Police for their help.

Councilor McNabb asked for council’s consent to add item 11 O to the agenda.  All agreed.  

Ordinances and Resolutions  
The order of voting was rearranged to hold the ordinances and resolutions that needed four votes to pass until the Mayor arrived.

Appointment Resolution #130 of 2002 authorizing an appointment to the Historic Resource Review Board. Vote: Councilor Jacobs, McNabb and Hunter yes. Mayor Carnicelli and Councilor Dempsey absent. PASSED

Appointment Resolution #131 of 2002 authorizing a re-appointment to the Youth Commission. Vote: Councilor Jacobs, McNabb and Hunter yes. Mayor Carnicelli and Councilor Dempsey absent.  PASSED

Appointment Resolution #132 of 2002 authorizing appointments to the Youth Commission. Vote: Councilor Jacobs, McNabb and Hunter yes. Mayor Carnicelli and Councilor Dempsey absent.   PASSED

Sidewalk Resolution #136 of 2002 authorizing the installation of sidewalks to be charged back to the owner over a five (5) year period and to be charged to Account #HA5497.440-001.  Vote: Councilor Jacobs, McNabb and Hunter yes. Mayor Carnicelli and Councilor Dempsey absent.  PASSED

Sewer-Water Repair Program Resolution #137 of 2002 authorizing the replacement of a sewer line under the Sewer-Water Repair/Replacement Program. Vote: Councilor Jacobs, McNabb and Hunter yes.  Mayor Carnicelli and Councilor Dempsey absent. PASSED

Council Resolution #138 of 2002 authorizing the City Manager to advertise for bids for Cold Water Meters for the Water.  Vote: Councilor Jacobs, McNabb and Hunter yes. Mayor Carnicelli and Councilor Dempsey absent.  PASSED

Award Resolution #139 of 2002 authorizing award of bid for a four-wheel drive vehicle for the Auburn Police Department. Vote: Councilor Jacobs, McNabb and Hunter yes. Mayor Carnicelli and Councilor Dempsey absent.  PASSED

Council Resolution #141 of 2002 authorizing the Club House located at Jack Clifford Field (formerly known as the Y-Field) be named after Jack “Monk” Curtain.  Vote: Councilor Jacobs, McNabb and Hunter yes.  Mayor Carnicelli and Councilor Dempsey absent. PASSED

Council Resolution #140 of 2002 authorizing the Mayor to execute a one (1) year agreement between the City of Auburn and the City of Auburn Assistant Fire Chief’s Association of the International Association of Firefighters AFL-CIO Local 4021.
 Vote: Councilor Jacobs, McNabb and Hunter yes. Mayor Carnicelli and Councilor Dempsey absent.  PASSED

At 6:05 Councilor McNabb asked for motion to recess briefly until the Mayor arrived.  No motion.  

Councilor McNabb suggested that council have the second public to be heard while council waited for the Mayor.  

Glen Carver, Evans St. – asked if any research had been done about requiring contractors to hire local labor.  Corporation Counsel Tom Leone responded no.

Councilor McNabb called for a recess at 6:10PM

Council resumed at 6:30PM – Mayor Carnicelli called the meeting to order.  

Council Resolution #128 of 2002 determining that the 2002 Road Program is a type II action for purposes of the New York State Environmental Quality Review Act regarding the reconstruction and resurfacing of the City’s existing streets and roads.  Councilor McNabb, Jacobs, Hunter and Mayor Carnicelli vote yes.  Councilor Dempsey absent. PASSED.

Bond Ordinance #12 of 2002 of the City of Auburn, New York, authorizing the issuance of $850,000 Serial Bonds to finance the cost of the 2002-2003 Road Improvement Program.  Motion to table by Mayor Carnicelli, seconded by Councilor McNabb.  Councilors McNabb, Hunter and Mayor Carnicelli vote yes.  Councilor Jacobs voted no and Councilor Dempsey was absent.  TABLED.

Award Resolution #129 of 2002 authorizing awards for the 2002 Road Program.  PULLED.

Land Sale Resolution #133 of 2002 authorizing the Mayor to execute any and all documents necessary for the sale of a portion of Glen Avenue, a paper street, and the unopened portion of Elm Street to the Unitarian Universalist Church, 607 North Seward Avenue, Auburn, New York, for an amount of Two Thousand Five Hundred ($2,500) Dollars.  Councilor Jacobs, McNabb, Hunter and Mayor Carnicelli vote yes.  Councilor Dempsey absent.  PASSED.

Land Sale Resolution #134 of 2002 authorizing the Mayor to execute any and all documents necessary for the sale of a portion of Glen Avenue, a paper street, to the Women’s Health Specialist, LLP, 615 North Seward Avenue, Auburn, New York for an amount of Two Thousand Four Hundred ($2,400) Dollar.  Councilors Jacobs, McNabb, Hunter and Mayor Carnicelli vote yes.  Councilor Dempsey absent.  PASSED.

Land Sale Resolution #135 of 2002 authorizing the Mayor to execute any and all documents necessary for the sale of 33 Pulaski Street to Ronald McLane for an amount of One Thousand ($1,000) Dollars. Councilors Jacobs, McNabb, Hunter and Mayor Carnicelli vote yes.  Councilor Dempsey absent.  PASSED

Council Resolution #142 of 2002 authorizing the Mayor to enter in to an Agreement with the ADP/BID to fund an amount of seven thousand five hundred dollars for its various programs.  Sandra Craner, Executive Director of the Auburn Downtown Parternship spoke to council to explain what the funds would help them do for downtown.  Vote: Councilors Jacobs, McNabb, Hunter and Mayor Carnicelli vote yes.  Councilor Dempsey absent.  PASSED

Other Business –
Councilor McNabb suggested that debris removed at a location on Aurelius Ave be removed.
